PlaceBuilder is a website owned by The Future Fox Ltd, which is a company registered in England and Wales. Our mission is to accelerate the development of smart, sustainable, and people-focused cities, and we do this by making it easy for anyone to influence planning decisions. 

This is our updated Privacy Policy going into effect on the 2nd of November.

2. Data we collect

  1. We record the suggestions and preferences you make on our website. Your suggestions are analysed anonymously along with all other suggestions from your community. 
  2. When visitors leave comments on the site we collect the data shown in the comments form
  3. We collect the visitors' browser user agent string  (which identifies the operating system and the browser you are using) so we can serve different web pages to different web browsers and different operating systems .
  4. Upon your agreement, we collect your postcode and demographic data so we can process the suggestions you provide through our website more effectively and make sure they are representative. 
  5. We use a third-party service, Google Analytics, to collect information on how you use the site, using cookies and page tagging techniques. The information Google and we collect doesn't identify anyone, and is kept for a maximum of 38 months.
  6. We use a third- party service, Hotjar,  to better understand our users’ needs and to optimize our service. The information Hotjar captures includes a device's IP address (stored in an anonymous form), device screen size, device type, browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf and we don't have access to any personal information.

All the information we collect is anonymous and does not identify anyone. We do not collect any personal data and we do not share your information with third parties or use it for any other purpose other than analysing your suggestions.  All our data is stored in the UK for a maximum duration of 12 months except for google analytics data which is stored for a maximum of 38 months.

3. Why we collect data

We gather this information in order to:

  1. Analyse your suggestions and provide recommendations 
  2. Improve the site by monitoring how you use it
  3. Avoid automated spam and abuse 
  4. Improve cybersecurity

4. Cookies 

Our website will place “cookies” on your computer to help improve your experience when you visit our site, detect spam and navigate through our site. You can delete cookies using your browser settings (these vary depending on which software you are using). We use the following cookies:

Essential cookies (always enabled) 

  1. A cookie responsible for the session identifier. This is an anonymous non-tracking cookie that expires at the end of the session or after 24 minutes. Its’ only purpose is to generate an anonymous session identifier that allows us to process your data. 
  2. Anti-CSRF cookie to prevent attacks. This is a session-only cookie that sends an encrypted identifier between you and our web app. It is an anonymous cookie that expires at the end of the session.  
  3. Cfduid cookie to detect malicious visitors and prevent attacks. It uses an anonymised version of your IP address. The cookie is a session-only cookie that expires after 30 days.
Analytics cookies (enabled unless you decline our cookie's policy) 

  1. Google Analytics and Hotjar use HTTP cookies to remember what a user has done on previous pages / interactions with the website. You can opt out of Hotjar tracking by turning on the Do Not Track header in your web browser. If you decline our cookies policy, Hotjar and Google Analytics cookies will be disabled. 

We don't use any other cookies, tokens or beacons. We do not store your IP address in any format in our database. 

5. Facebook (visitor action pixel)  

We use the “visitor action pixels” from Facebook Inc on our website. This allows user behavior to be tracked after they have been redirected to the PlaceBuilder website by clicking on a Facebook ad. 

This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes (only when you have been redirected from Facebook to our website). The data collected in this way is anonymous to us, i.e. we do not see nor have access to personal data of individual users. However, this data is stored and processed by Facebook, which is why we are informing you. 

6. Complaints

If you feel we have been unable, or unwilling, to resolve your information rights, you have the right to lodge a complaint with the Information Commissioner's Office (ICO). The ICO is the supervisory authority responsible for data protection in the UK.

These Terms of Use ("Terms") govern the access, browsing and use by the users ("User" or "Users", as applicable) of the PlaceBuilder website and associated services including any of its subdomains and/or sections ("Website").

2. DESCRIPTION OF THE WEBSITE

General Description. The Website is owned by The Future Fox. It is a digital engagement tool that allows you to share your views and opinions about specific topics. 

Adults Only. The Website is intended for adults only. You affirm that you are more than 16 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. The Future Fox will never knowingly solicit nor will it accept personally identifiable information from individuals known to be under sixteen (16) years of age.

Right to Modify the Website. The Future Fox reserves the right to immediately change, suspend, remove, or discontinue any part of the Website or any content for any reason, without prior notice or liability.

Changes to these Terms of Use. The Future Fox reserves the right to modify these Terms of Use at any time, and without prior notice, by posting amended terms on this Website. Changes and clarifications will take effect immediately.

3. USER CONDUCT

You acknowledge that the Website is for personal use only. You agree that you will not use the Website for any commercial purposes.

You must not send us, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.

You must not send us, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," "affiliate links," or any other form of solicitation.

You must not violate any local laws in your country or jurisdiction (including but not limited to intellectual property laws).

You must not use the Website for any illegal or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable Content.

The Future Fox reserves the right, in its sole and absolute discretion, to reject, refuse to post or remove any information sent to us by you.

We respect the intellectual property rights of others, and we ask that our website visitors do the same. It is our policy to disable access to or remove material that we believe in good faith to be infringing on a copyrighted work. 5. LIMITATION OF LIABILITY

The User acknowledges and agrees that he/she/they uses the Website at the User’s own risk and under the User’s responsibility and, therefore, The Future Fox or any company or individual working on their behalf do not accept any responsibility for misuse or use in breach of these Terms.

The Future Fox does not warrant the availability or continuity of the Website, neither its reliability, quality, completeness, accuracy or whether they are fit for a specific purpose or activity. 

As way of example and without limitation, The Future Fox or any company or individual working on their behalf shall not be liable for any damages that may result from:

  • Interruptions, viruses, technical problems, interferences, omissions, unavailability, power cuts, failure of the telecommunication networks or the User’s equipment which are not our responsibility.
  • Delays or unavailability of the Website due to deficiencies or traffic overload on the Internet, in the communication network or the electricity grid. 
  • Third-party actions.
  • Unavailability of the Website due to maintenance or software updates.
  • Any other event beyond our direct control.

Save for the company’s wilful misconduct, and those cases in which due to the specific circumstances of the user involved or the nature of the matter, applicable law provides that liability cannot be limited by agreement, use of the website is at sole risk of the user and The Future Fox or any company or individual working on their behalf shall not be liable for any damage of any kind caused to the user as a result of using the website.

The Future Fox acts exclusively as a provider of a digital engagement service as requested by the User, without assuming any responsibility for consultation or engagement results.

The insertion of links in the Website does not imply any relationship, recommendation or supervision by The Future Fox of the linked website and, accordingly, The Future Fox does not accept any liability in relation to the content of any linked website except in the specific circumstances provided by the applicable law.

6. ENTIRE AGREEMENT

The Terms of Use, including the The Future Fox’s Copyright Policy and Privacy Policy, which are hereby incorporated by reference, constitute the entire agreement between you and The Future Fox and governs your use of the website, superseding any prior agreements between you and the The Future Fox.
